Terms & Conditions: Please carefully review the following Terms & Conditions to ensure a thorough understanding of each provision. Welcome to Simles. This website and its related services are operated by SIMLESS L.L.C-FZ, a company registered in Dubai, UAE. By accessing or using our services, you signify that you have read, comprehended, and agreed to be bound by this agreement. If you are ineligible to use the service or disagree with the terms and conditions, you do not have our permission to use the service. No agency, partnership, joint venture, or employment relationship is established as a result of these Terms & Conditions, and neither party has the authority to bind the other in any respect.
1. Agreement Overview These Terms of Use, herein referred to as "these Terms," outline the contract uniformly applicable between Simles, referred to as "the Company," and customers concerning the utilization of the eSIM data communication service and all associated services, collectively known as "the Service." Definitions:
● The Service: A service utilizing an eSIM to provide dedicated data communication in the specified country or region outlined in the User Agreement.
● eSIM: Technology enabling the use of the Service using the communication device and SIM card specified by the Customer.
● The User Agreement: An agreement between the Company and the Customer regarding the Service based on these Terms.
● The Customer: A party that has entered into a User Agreement with the Company or applied to do so.
● Telecommunications carrier: The company providing communications through the Service under a contract with the Company or the eSIM Provider, regardless of whether it is an MNO or MVNO. The Company retains the right to modify these Terms and will notify the Customer of any changes. Continued use of the Service after the Company has altered these Terms implies the Customer's agreement to the modifications.
2. User Agreement Application: To apply to enter into a User Agreement, the Customer must read and agree to the contents of these Terms. The application should be submitted using the method specified by the Company, such as filling in the prescribed information on the online application screen.
3. Service Overview: The Service is a communication service provided using the eSIM, allowing users to access communication services in countries and regions specified by the Company. The availability and quality of the Service may vary depending on network coverage, geographic location, and other factors beyond the SIMLES's control. SIMLES does not guarantee uninterrupted or error-free Service and is not responsible for any issues arising from network congestion or technical limitations.
4. Customer Responsibility: The Customer is responsible for using the Service lawfully and solely for their own benefit. If the Customer's communication device is connected to a communication network by a method other than provided by the Company, the Customer may incur additional communication charges. The Company holds no liability in this case, except if the Company is at fault. The Customer agrees not to use the Service for any illegal, fraudulent, or abusive activities, including but not limited to unauthorized access to systems, distribution of malicious software, or infringement of intellectual property rights.
5. Service Description: SIMLES offers a prepaid eSIM profile reselling service, providing users with access to competitive data rates while traveling abroad without the need for a physical SIM card.
6. Registration: Upon registration and use of the SIMLES application, you are bound by the Terms and Conditions of our service. Operating rules, guidelines, and procedures published on the application, subject to periodic updates, are also applicable.
7. Privacy Policy: Ensuring the security of your personal information is our priority. We employ industry-standard security technologies to protect against unauthorized access. While no security measure is infallible, we cannot guarantee absolute security. By accessing Simles, you consent to the use of your registration information for communication, feedback, and future service updates. You retain the right to request adjustments or deletion of previously shared information. This Privacy Policy may be periodically revised, and changes in the use of your personal information will be communicated to you.
8. Registered Intellectual Property Rights: Usage of SIMLES trademarks, logos, IP rights, commercial names, or copyrighted material associated with our services is strictly prohibited without prior consent. The use of Simles services does not imply any assignment of these rights to you or other service subscribers.
9. Simles Account: i. Activation of Simles Service: Request the Simles service by installing the mobile application or visiting our website. Activation is your responsibility. ii. Charges: Payments, in USD, are made via debit/credit card securely processed by a third party using Pay Express Elements. iii. Termination: You can terminate the service anytime after purchase. Simles may interrupt, suspend, cancel, or terminate your service without notice for any breach violating these Terms and Conditions. iv. Consequences of Termination: Deactivation results in loss of remaining paid days, with no refund for unused elements.
10. Use of Simles: You agree to use Simles services per these Terms and Conditions and applicable laws. Ensure your device is compatible and not carrier-locked. Refunds or bundle changes are possible for valid technical problems. ESIM deactivation may lead to loss of remaining data balance or credits. Immediate notification is required for lost or stolen devices. You are solely responsible for all content, information, and communications transmitted using the service. Refund requests will be considered only for technical issues that prevent the Customer from using the Service, provided such issues are reported within 24 hours of purchase. Refunds will not be granted for any unused data or credits after service activation.
11. Simles Wallet: Simles provides a wallet feature where users can top up funds and use them for purchases on the Simles website or app. The maximum amount that can be topped up in one transaction is $50, and the total balance in the wallet cannot exceed $100. Funds in the Simles wallet are non-refundable and cannot be transferred or used for any purpose other than purchasing eSIM services from the Simles app or website.
12. Indemnification: You are obligated to fully indemnify and hold Simles and its affiliates harmless for any matters related to the misuse or improper use of Simles services.
13. Limitation of Liability: Subject to applicable law, Simles will not be liable for any indirect loss. In any event, our liability will be limited to proven direct damages, not exceeding the total amount you paid as a service user under Simles services in the twelve months prior to the event causing the damage.
14. Modification: We reserve the right to modify or replace any of these Terms & Conditions, change, suspend, or discontinue services at any time without prior notice. It is your responsibility to periodically check these Terms & Conditions for changes.
15. Governing Law: These Terms & Conditions are governed by the law of Lebanon. Disputes shall be submitted to the Courts of Lebanon.
16. Third Party: When accessing third-party resources, you do so at your own risk. Simles is not responsible for the content, functions, accuracy, legality, or appropriateness of such websites or resources.
17. No Waiver: Our failure to enforce any part of these Terms & Conditions does not constitute a waiver of our right to later enforce them. For any waiver to be binding, we must provide you with a written notice of such waiver.
18. Force Majeure: We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control.
19. Warranties: Simles services will be provided professionally and diligently. We make no other warranty, express or implied, and you disclaim any warranty of fitness or satisfactory quality. Simles shall have no liability for any failure by Simles services to restrict or control your access to the device on which it is installed.
20. Refer and Earn Program: Participate in our Refer and Earn program to earn rewards for successful referrals. The program terms are available within the Simles app and are subject to change or termination at our discretion.
21. Data Measurement and Calculation: Data is measured in Gigabytes (GB) and calculated up to two decimal places. One Gigabyte is defined as 1,000,000,000 Bytes.
